Terms of Service

1. Acceptance
By using rithm.games (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. The Service is provided by Ryan Keys, operating as RITHM ("we", "us"). Together with the Privacy Policy, these terms form the agreement between you and us.
2. Eligibility
The Service is suitable for general audiences but is not directed at children under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian. If you create an account, you confirm that the information you provide is accurate and that you have the authority to agree to these terms.
3. Accounts
You can use most of the Service without an account. If you create one, you are responsible for keeping your password confidential and for everything that happens under your account. Notify us promptly at support@rithm.games if you believe your account has been accessed without your permission.
One human, one account. You may not create multiple accounts to manipulate leaderboards, achievements, or friend challenges.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Submit content (usernames, profile information, messages, bios) that is harassing, hateful, sexually explicit, threatening, defamatory, or that infringes anyone else's rights.
- Send unsolicited messages, spam other users, or use the friend or messaging features to advertise outside services.
- Attempt to bypass rate limits, defeat anti-bot protections, scrape the Service at scale, or interfere with other users' access.
- Cheat on leaderboards, manipulate game stats through automated tools, or submit fabricated scores.
- Reverse-engineer the Service, attempt to extract source code from compiled bundles, or probe for security vulnerabilities outside of a coordinated disclosure.
If you discover a security issue, please report it responsibly to support@rithm.games before disclosing it publicly.
5. User Content
You retain ownership of any content you submit (such as your profile information, bio, messages, and uploaded profile picture). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display that content for the purpose of operating the Service.
We may remove user content that violates these terms or that we determine, in good faith, is harmful to other users or to the Service.
6. Pro Subscriptions
The Service offers an optional Pro subscription with two billing options:
- Monthly: $7.99 USD per month, billed monthly.
- Annual: $60.00 USD per year, billed once per year.
Pro unlocks unlimited daily practice sessions, streak protection, advanced exercises, full progress analytics, and removes ads. Payments are processed by Stripe; we do not see or store your card details. Subscriptions auto-renew until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and the Service remains available at the Pro tier until that period ends.
Refunds: Because the Service is digital, sold on a recurring basis, and immediately accessible, payments are generally non-refundable. We will, in good faith, consider refund requests for clear cases of mistaken or duplicate billing — email support@rithm.games within 14 days of the charge. Where local law (for example, the EU's distance-selling rules) requires a refund right that is broader than this paragraph, that law controls.
Price changes: We may change the Pro price. If we do, we will give existing subscribers at least 30 days' notice before the new price applies to their next renewal.
7. Free Plan
The free plan grants access to every game and the full 24-week curriculum, with a limit of three practice sessions per day. We may adjust the free plan's features and limits over time as the Service evolves. We will not make material reductions without prior notice.
8. Intellectual Property
The Service, its design, its games, its tutorials, its curriculum, its written content, its software, and its trademarks are owned by Ryan Keys and protected by copyright, trademark, and other intellectual property laws. You may use the Service for personal, non-commercial learning. You may not copy, redistribute, resell, or republish the Service or its content (including tutorial text and curriculum materials) without prior written permission.
Music theory concepts themselves are not owned by anyone; you are free to learn them, teach them, and use them however you wish.
9. Termination
You may stop using the Service at any time and request account deletion as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms, after notice where reasonably possible. If we terminate a paid account for violations, we will not refund the unused portion of a paid term.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that the educational content is exhaustive or suitable for any particular exam, audition, or professional certification. Music theory has many regional traditions; we present the most widely-taught Western framework.
11. Limitation of Liability
To the extent permitted by law, in no event will RITHM, its operator, or its service providers be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our aggregate liability for direct damages will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) twenty US dollars. Some jurisdictions do not permit certain limitations on liability; in those jurisdictions, this section applies only to the maximum extent permitted.
12. Changes to These Terms
We may update these terms from time to time. The "Last updated" date will change when we do. Continued use of the Service after a change means you accept the updated terms. Material changes will be announced on the site or by email to registered users.
13. Governing Law
These terms are governed by the laws of the United States and the state in which RITHM is operated, without regard to conflict-of-laws principles. Any dispute will be brought in the courts located there, except where applicable consumer-protection laws give you the right to bring a dispute in your home jurisdiction.
